During the last year there have been major developments in public sector employment and related laws. These include issues relating to loss of pension rights & benefits, reductions in pay under emergency legislation and restructuring, to name just a few. Now we have the spectre of the Agency Workers Directive.

Description


Employment law is a complex subject with, it seems, an ever increasing amount of case law and legislation to understand and apply in the workplace. It can be particularly complex for those in the public sector or working in state bodies where additional statutory and other rules may apply. This is particularly so in current times in light of the moratorium and other control frameworks, as well as the Croke Park Deal.

This seminar is delivered by leading Dublin law firm, McCann FitzGerald, who advise some of Ireland’s biggest state sector employers. With ample time built into the programme for Q&A sessions and two group exercises to reinforce learning, it is ideal for those working in the public sector who need to understand how today’s employment policies impact on their organisation.

An Overview of the Public Sector Landscape:
Including a review of significant developments in relation to the Croke Park Agreement and the Implementation Body, focussing on the practical issues facing public sector employers and best practice guidance, particularly in respect of the area of redeployment.

Fixed Term Contracts and Managing Resources in the Public Sector:
A high level review of the law as it applies to fixed-term contracts and recent Labour Court cases, including an analysis of objective justification for decisions to renew fixed-term contracts. An overview of general resource issues arise in this context, particularly for employers in the public sector in light of the Croke Park Agreement and other recent government restrictions.

10.45am Case Study 1:
Working in groups: Analyse a situation involving a fixed-term employee’s series of fixed-term contracts over a number of years, the rationale for renewal of those contracts over that time and also a review of the fixed-term employee’s benefits compared to a permanent comparable employee. Analyse against a backdrop of increasing budget restrictions and a reorganisation of staff in the business as a result, including redeployment and other issues.

Public Sector Remuneration – Variation to Terms and Conditions of Employment:
As the economy continues to be fragile, public sector budgets are becoming under even more strain. This provides a brief overview of recent cases in this area and the effect on public sector employers against the backdrop of the Emergency Financial Measures legislation and its impact on pay and pensions.

Agency Workers:
The draft legislation to transpose the Temporary Agency Workers Directive into Irish law will, when enacted, have retrospective effect from 5 December 2011. This legislation will have significant effects on the manner in which agency workers can be engaged in the public and private sector.  We take you through the key components including the definition of basic working and employment conditions, equal treatment, identifying comparators and will set out  practical steps to be taken for the purposes of complying with the legislation.

Case Study 2:
Working in groups, analyse a scenario where there are a number of agency workers in a company with varying benefits compared to comparable non-agency staff and consider the issues that arise in regards to the Agency Workers legislation and the retrospective effect of same.
