This case concerned an appeal against the Rights Commissioner’s Recommendation to review the claimant’s demotion one year after demotion for failure to carry out his duties. The Court felt that the demotion in perpetuity was excessive in the circumstances; hence he should be reinstated in his role from the date of the Court’s decision, as one year had elapsed.
