This case involved a slaughterhouse employee, awarded some €415,000 damages for back pain. The plaintiff contended that, given the nature of the defendant’s defence, and the hurt that the allegations of malingering, the plaintiff was entitled and should have been awarded aggravated or exemplary damages.
