This case concerned an employee’s appeal in respect of his application for promotion. In line with the appeals process within the defendant University the case was referred pursuant to Section 20(2) of the Industrial Relations Act, 1969. Notably the Court was not responsible for deciding on the merits of the Applicant, but merely to ensure the selection process was not unfair. The Court held that no evidence existed that the criteria were applied incorrectly and the appeal with dismissed.
