This is an appeal by Ervia (the Respondent) against the decision of an Adjudication Officer under the Payment of Wages Act which found in favour of the Complainant and awarded the sum of €5,000.00. The Respondent contended that the Adjudication Officer erred in finding that there were reasonable grounds to extend the time limit and also in finding on the substantive claim under the Act. 

The Complainant brought a complaint against the Respondent over a performance related award. The Complainant received a letter informing him of his Performance Related Award which was to be paid at the end of the month. In May 2018, the Respondent provided him with a breakdown of the Performance
