There has been a surge in litigation in recent years with respect to the enforcement by employers of retirement ages. This is not surprising given the attraction of delayed retirement for employees who wish to stay on in the workplace, and the desire of an employer to use retirement of its employees as a cost-cutting measure. Disputes can arise and employers may be faced with claims before the Employment Appeals Tribunal and the Equality Tribunal.
