In the face of so much economic uncertainty, many employers are looking at the scope for shedding staff via such an arrangement. Coincidentally, the Workplace Relations Commission (WRC) recently adjudicated upon two cases in this area. In both cases, redundant employees attempted to renege on the provisions of the relevant agreement. Alas, in both instances, it was held that the agreements’ provisions stood solid. Hence, the case law in this important area of employers’ and workers’ rights continues to confirm the key constituents of an effective ‘waiver’
