Dismissed: Use of Social Media in the Workplace

The tremendous growth in the use of social media has led to a number of workplace issues concerning inappropriate online comments made by employees about other colleagues and/or their employer. This year, in The British Waterways Board v Smith, the UK Employment Appeal Tribunal (“EAT”) upheld the employer’s dismissal of an employee for gross misconduct after a series of inappropriate Facebook posts.


The Facts

The British Waterways Board (“BW”) had employed Mr Smith since 2005. Mr Smith’s role required him to be on “standby” during which time he was not allowed to drink alcohol.

Issues arose in Christmas 2012, when one of Mr Smith’s supervisors alerted BW’s HR department to negative comments
