The Organisation of Working Time Act 1997 provides that employers decide when annual leave may be taken. However, this is subject to the employer taking into account the need for the employee to reconcile work and any family responsibilities, and the employee's opportunities for rest and recreation. The employer is also expected to consult with the employee not less than one month before the day on which the annual leave is due to be taken. As such, it best to implement this policy as reasonably as possible and, rather than forcing the employee, reach agreement in relation to this leave.
