We have a member staff returning from maternity leave. She was employed full-time but now wants to go part-time. The role is getting busier and busier and we just don't think we can carve her job into two part-time jobs. Can we refuse her request?

The Labour Relations Commission has produced a Code of Practice on Access to Part-Time Working. The Code seeks to encourage best practice and conformity with the provisions of the Employment Equality Acts 1998 and 2008 and the Protection of Employees (Part-Time Work) Act 2001.

The Code provides that the facility to change the existing hours of work of employees is a matter to be agreed between the employer and the employee, rather than a statutory entitlement.
