Employees have rights under social welfare legislation to occupational sickness benefit from the State, provided they have the appropriate pay related social insurance (PRSI) contributions. This benefit is graduated according to average weekly earnings, and there is no payment during the first three days of illness. Any social welfare or other benefits recoverable by employees may be set off against any payments made to them by the employer.
