Employees have rights under social welfare legislation to occupational sickness benefit from the State, provided they have the appropriate pay related social insurance (PRSI) contributions. This benefit is graduated according to average weekly earnings, and there is no payment during the first three days of illness. Any social welfare or other benefits recoverable by employees may be set off against any payments made to them by the employer.
As employers are not obliged by statute to provide Company sick pay (although most provide some level of benefit), it is advisable to detail the extent to which sick pay may be paid in either the employment agreement or the company handbook/policy
