In Ireland, there is currently no prohibition on employees receiving their pension whilst working and receiving their ordinary remuneration, and subject to the rules of the pension scheme catering for late retirement. Notwithstanding the employee’s right to challenge compulsory retirement, employer’s consent is required for an employee to retire after his/her specified retirement date. Many pension schemes make provision for late retirement, and the rules surrounding later retirement should be reviewed by the employer and the trustee to ascertain the position.
