1. The Transfer Regulations and Outsourcings/Service Provider Changeovers

The EC (Protection of Employees on Transfer of Undertakings) Regulations 2003 (the “Transfer Regulations”) protect employees in business transfers. Where an ‘undertaking’ transfers from one employer to another, the employees wholly or mainly assigned to that undertaking essentially migrate with it. Their continuity of service and terms and conditions of employment are preserved. The Transfer Regulations implement the European Acquired Rights Directive in Ireland (the “Directive”).
